These Terms and Conditions govern your access to and use of the Avolve Trucking Solutions Inc. platform, including our website, mobile applications, and related services (collectively, the “Platform”), operated by Avolve Trucking Solutions Inc.
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
Avolve Trucking Solutions Inc. is a unified trucking solutions platform designed to connect drivers, and trucking businesses with independent third-party professionals, service providers, tools, and industry partners.
Avolve does not provide:
● Legal services
● Compliance or regulatory services
● Safety determinations
● Financial, or operational advice
All services accessed through the Platform are provided by independent third parties. Avolve does not control, manage, endorse, supervise, or guarantee any third-party services.
You must be at least 18 years of age and legally capable of entering into a binding contract to use the Platform.
Certain features of the Platform may require you to create an account.
You agree to:
● Maintain the confidentiality of your login credentials
● Accept full responsibility for all activity conducted under your account
Avolve is not responsible for any loss or damage resulting from unauthorized access due to your failure to safeguard your credentials.
Information provided through the Platform is for general informational purposes only.
Avolve does not provid:
● Regulatory or compliance determinations
● Safety assessments
● Employment or financial advice
You are solely responsible for consulting qualified professionals regarding legal, regulatory, compliance, safety, financial, and operational matters applicable to your business.
The Platform may provide access to or connections with third-party providers, including but not limited to:
● Compliance consultants
● Roadside assistance providers
● Maintenance and repair services
● Industry software tools and partners
All third-party providers operate independently. Any agreements, transactions, services, or disputes are strictly between you and the applicable third party.
Avolve expressly disclaims all responsibility or liability for:
● Outcomes or results
● Fees or pricing
● Delays or failures
● Disputes or damages
The Platform may provide visibility into or access pathways related to third-party industry databases, including Carrier411, FreightGuard, or similar systems.
Avolve:
● Does not create, modify, or remove records
● Does not guarantee accuracy, completeness, or resolution outcomes
All database content is governed by the terms of the respective third-party providers.
Electronic Logging Device (ELD) and operational data integrations are provided through third-party systems.
Avolve is not responsible for:
● Device functionality or performance
● Regulatory compliance of third-party systems
You remain solely responsible for ensuring compliance with all applicable ELD and transportation regulations.
You agree not to:
● Misrepresent your identity or business information
● Interfere with or disrupt Platform functionality
● Attempt unauthorized access to systems or data
● Upload malicious, harmful, or unlawful content
Avolve reserves the right to investigate and take appropriate action for violations of this section.
All Platform content, software, trademarks, logos, and materials are owned by or licensed to Avolve and are protected by applicable intellectual property laws.
No rights or licenses are granted except as expressly stated in these Terms.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.”
To the maximum extent permitted by law, Avolve disclaims all warranties, express or implied,
including but not limited to:
● Fitness for a particular purpose
● Accuracy, reliability, or availability
Your use of the Platform is at your own risk.
To the maximum extent permitted by law, Avolve shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:
● Business interruption
● Data loss
This limitation applies regardless of the legal theory under which liability is asserted.
You agree to indemnify, defend, and hold harmless Avolve Trucking Solutions Inc., its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising out of:
● Your violation of these Terms
● Your interactions with third-party providers
Avolve may suspend or terminate your access to the Platform at any time, with or without notice, and with or without cause, at its sole discretion.
Upon termination, your right to use the Platform will immediately cease.
These Terms shall be governed by and construed in accordance with:
● The laws of the Province of Manitoba and the federal laws of Canada applicable therein,
without regard to conflict-of-law principles, for users located in Canada.
Avolve reserves the right to modify these Terms at any time. Continued use of the Platform following any changes constitutes acceptance of the revised Terms.
